Need HELP ASAP
Hello!
I am desperately looking for an advice. My mother came as a tourist and then decided to apply for a greencard while being in the US. We filed the I-I30 and I-485 forms on 11/22/16 and haven’t heard anything since then. The filing fees are not cashed yet. I called the customer service who could not locate any records of her. I’ve emailed two times to the lockbox mailbox in January with no reply received yet. Her visa expires on 1/28/17. My questions:
- Should she leave US before her visa expires and waits in her country? If she does, will the case still be valid if USCIS could locate her paperwork, which I doubt.
- Should I try to file the visa extension? If yes, will it impact her I30/485 case?
Consulted two layers and one of them said she must go and another lawyer said wait until the acknowledgement letter receipt and not to file the visa extension…. Very lost. ?(((
