AP approval risk of 10yr bar and minor charge for reckless driiving
HI EVERYONE. MY HUSBAND IS A DACA RECIPIENT FROM MEXICO.
TIMELINE FOR AP:
APPLIED 11/18, RECIEPT SENT EARLY DECEMBER, APPROVAL RECEIVED 4/24

US PASSPORTS FOR BOTH OUR CHILDREN AND MYSELF RECEIVED WITHIN 10 DAYS FOR PASSPORT APPS BEING SUBMITTED.
 
We are not sure if he should risk leaving the US even though he has been granted DACA twice and has been Approved for his AP because he is at risk for having the 10yr bar implemented because of 2 EWI'S ONCE as a minor and ONCE at 18yrs with 3 years in between reentry. He was also charged with reckless driving for passing in a no passing zone to avoid being in a major accident due to a guy going way under the speed limit ahead of us. There was a car behind ius and there was no time to brake so he was forced to pass. He was given credit for time served, had his license suspended and then was sent to the Tacoma Detention Center. We posted his $7k bond, got a good lawyer, he was granted DACA, and his case was dismissed.

OUR QUESTION IS:
HAS ANYONE WHO WAS AT RISK OF HAVING A 10YR BAR AND A MINOR CHARGE STILL SUCCESSFULLY LEFT THE US RETURNED. OUR ATTORNEY SAID THIS IS OUR ONLY SHOT UNLESS MYSELF OR ONE OF MY CHILDREN JOINS THE MILITARY. PLEASE HELP!?!
