Adjustment of status for F2A category
Hello All,
i need some clarity in this process will really help because i'm confused with (lawyers, USCIS, NVC ) giving me different information.
I filed my I 130 last year and my priority date is July 18 2016. My spouse is a green card holder and i am in US on H1B right now.
MY I 30 got approved in January 2017 and case got sent to NVC and i got the case number from NVC as well.
couple of question?
1. Am i eligible for adjustment of status and EAD. USCIS told me since my spouse is a GC holder i'm not eligible for either is that true?
2. if i can file for AOS and EAD whern is the right time? looking at october 2017 bulletin the dates to be filed table shows november 2016 for India and F2A which makes my priority date before the the date on the bulletin.
3. NVC reached out to be couple of days ago to sent support docs like income, tax, marriage affidavit etc that is a step in which process? when i asked NVC about EOS and EAD they said i need to call USCIS and USCIS says NVC will handle everything after i130 being approved.
CAn any one tell me what are the next steps
