ADJUSTING status through marriage with pending asylum
After waiting 8 months after the interview, today we received an RFE for expired medical exam. The long wait was due to the asylum pending case. USCIS had requested a copy of the asylum file and just received it a couple weeks ago. We were so excited thinking we are finally reaching the finish line, until we got the RFE for the medical exam today. So frustrating...
The issue is that my husband is in Florida right now helping his brother move out to a new house, and we are not sure if it would be ok to do the exam there with a civil surgeon or if he has to come back to upstate New York to do it. We want to do it ASAP but he can’t come back right away, he at least needs couple more weeks to come back. I told him to find a surgeon there in Florida and to do it tomorrow. I called USCIS customer service and they said any civil surgeon is fine, but you never know, they tend to give conflicting information.
