AOS filing timeline + J1 complication (not really!)
Hi all,
We got married in Nov. 2016 and decided to file for a AOS in Jan 2017. We hired a lawyer for this purpose, who was excellent. I already have a work permit (H1B), so I wasn't super anxious. However, I have a previously J1 which was stamped with a 212E restriction, so my anxiety was limited to that.
Please see my timeline below and let me know if you have any questions:
- Feb. 17th, 2017: Filed i485 (Month 1)
- March 6th 2017: Received the receipts
- April 3rd, 2017: Received notice for Biometrics appointment (Month 1.5)
- April 10th, 2017: Biometrics appointment (Month 2)
- May 19th, 2017: Received approval notices of Advanced Parole (Month 4)
- May 22nd, 2017: Received Advaned Parole (and EAD Card)
Traveled abroad using Advanced Parole for 2 weeks in October 2017. There was no issue. We flew in and out of JFK, New York and everything was smooth.
- Jan 9th, 2018: Received Notice of Interview (Month 12)
Our interview was scheduled for Feb. 9th 2018, and I needed to travel on an emergence the week before. I was advised that it was better to travel before the interview on advanced parole, than immediately after (as we didnt know what direction , the interview would go in). I traveled between Jan. 23rd 2018 and Feb., 4th 2018.
- Feb. 9th, 2018: We had our interview in the Federal Plaza Building, Manhattan.
The interview was scheduled for 2 PM, of course we waited till 4:15 PM to be seen. The interview itself lasted 15-20 mins. I was questioned about the J1 issue, but my attorney and I were prepared with the information that the 212E Restriction didn't apply to my case, as I was not funded by a governmental institution, nor am I a medical personnel and neither was I on the skills list for my country to want me back. Perks of being in the non- profit sector, I guess! The interviewer ended up consulting another senior interviewer, who said, there should be no problem in approving our petition for AOS. We walked out after thanking the interviewer, who congratulated on being "approved". She handed us a paper, which "Pending Review" checked off.
We were hoping get approve the very next week but, that didnt happen.
- March 2nd 2018: The status of my petition changed to "New Card is being produced" on the USCIS Website. (Month 14)
I believe that's a great sign and I should have the actual card soon enough.
