Lawyers suck and outdated new policies
Lawyers suck, especially now with new rules and policies. Mine sucks big time as well. I will explain what I know from infopass and other info.

First, your i485 is the application to get a GC this is by far most important. One of the fastest timelines and ways to get it is i485 c9 via marriage to USC. So the timelines I will use are for that mainly, if your case is different expect longer waits.

Historically the entire i485 process took 4-6 months and all cases within 1 year. Then sometime ago USCIS fell back to all cases taking 8months or more, and lots over 1year and some over 2 years.

Thus USCIS created the i765 process to give you interim benefits right away while your i485 is pending. Till up to early 2017 all i765 cases basically were processed in 90 days and expedites took 30-45 days.

Unfortunately the current administration and one before saw that timelines for i485 continue to get worse and worse, and lots of people are almost on the i765 for over 1 year while their i485 is stuck pending. Basically just cue some Trump jokes here...

The result has become that the current administration has decided to bring focus back to mainly the i485 process. They done this by making the i765 be atleast 4-5 months and usually 5 plus months now vs 90 days for almost everyone. While on other hand easier cases like lots of k1 processes have their i485 timeline to be 5months total again.

So some people are benefiting and many others are stuck waiting. Versus everyone stuck for 8months to over 1 year.

What does this all mean for us all waiting? Based on infopass and other info I got. You need to push updates and questions around your i485 now and not just focus on i765 first coming like our idiot lawyers are telling us. That was old world.

First you need to see you are at the “Ready to schedule interview phase”. Also if you didnt frontload your i485 application like most idiot lawyers say dont you could see your case drag. Cause again they are focused on the i485 mainly again.

So try to push SRs on on your i485 as well and see what is holding it up, because without background checks done these days they will delay i765 for sure.
