priority date retention for derivative (past 21)
Hi, can anybody share your knowledge on this?
I just acquired permanent residency thru EB3. I have a child that aged-out (past 21 but legally here in the US thru F1). He was mentioned/included in my I-140 but wasn't included on my adjustment of status (bec he turned 21). Am i correct to believe that:
1) he will automatically be transferred to F2B ?
2) do i need to file a petition? (ds-130)?
3) can i use or retain my employment base priority date for his changing of status?
has anybody been on the same situation?
I know F2B dates are far yet and might take several years to be current. But i want to know shold i or should i not file a petition?
