Misdemeanor assault, out of state move with a pending N400
I’ve done tons of research regarding things such as moving out state with a pending N400 application as well as having a misdemeanor assault charge. After waiting for over a year I had nothing but time to do so. I appreciate those who posted their experiences as for it put my mind at ease during my citizenship journey, so now it is time for me to return the favor and hopefully help others as well. If you don’t want to spending time reading a bit of someone’s life story I suggest you skip my post.

In 2008, I was a correctional officer in the state of Nevada, my mother’s neighbor threatened her and after finding out I confronted the man. I was arrested and accused of assault with a deadly weapon (felony charge). After a few months I was forced to resign and cashed out my retirement which at the time totaled 35k. I hired an attorney and never took any plea deals as for I did not do what the man accused me of, 15k in attorney fees and after the trial the jury found me innocent of the felony charge, but guilty of misdemeanor assault due to me going and confronting the guy.

I moved to Texas in 2012 with nothing more than clothes and joined the Texas department of criminal justice. Promoted to sergeant and then lieutenant within 4 years and in June of 2017 I applied for citizenship out of Houston TX. In January 2018, I moved to Phoenix AZ, due to my wife being hired with the Phoenix police department and my two kids from a previous relationship who had re-located to the Phoenix area.

I completed the online address change form and harassed USCIS as for they wouldn’t confirm wether the change of address took effect or not, I scheduled an infopass and confirmed it. (Do not trust the simple online address change, be sure to follow up)

Interview scheduled on May 2018, Police recruit packet dropped the next day (Arizona law requires anyone applying for a police job to be a US citizen) Phoenix police allowed me to do the written, physical, oral board and polygraph which I passed but held off on the medical and phycological test due to the agency having to pay for those not wanting to take a chance due to the pending citizenship interview.

Interview July 10, 2018.

I bring the kitchen sink with me, although I’m 35 and technically outside the age for selective service proof, the interviewer asked for proof. All men out there, if you have it bring it no matter if others tell you not to. The interviewer was extremely professional and to the point, no small talk. She asked where I work now and I showed her my Phoenix PD paperwork that I’m simply pending the result of my citizenship status, she asked for proof that I supported my children when I moved to Texas so again gentleman ensure to have your baby momma complete a letter stating you have always did the right thing and supported your kids, if you haven’t shame on you. She asked for the certified disposition of my charge, which I had and last year tax returns.

The test was to read when do we celebrate Independence Day?
And write indenpence day is in July.

In the end I was recommended for approval. I can’t emphasize it enough, don’t get discouraged and give up. My story is not a fairy tale, and yet here I am, be strong and trust the process. Good luck everyone!!!!
