Dear All,
One of my friends (F-1) submitted I-130 based on his immigrant spouse (not USC). He has been waiting for more than 15 months and the decision has not made yer. His OPT will be expired soon and he did not get a good job who can apply for H-1B. In order to stay in status, he needs to go back to school which lots of costs involved. My question is can he apply for I-485 based on his pending I-130 and stay in the USA legally?
