Very worried about my N400 Interview
Hi,
I obtained my green card thru my ex-wife who is a US Citizen. I applied for the US Citizenship based on the 5 years rule.
My first marriage with the US Citizen happened in Jan 2013 and divorced decree shows divorce data as June 2016. The reason for the divorce, my ex-wife and I had an amazing relationship, she has a daughter from another man and I we had no issues with that, we were dating for about 2 years prior to getting married. After getting married, I had asked my ex wife that I wanted to have a child and she was not very welcoming my request and started avoiding that topic. I tried very much to talk about it and she just kept on avoiding the topic and used to get very angry and the normal talk became a discussion...we started having issues, basically because of the fact that I wanted a child but she just kept on ignoring my request. After a lot of trying and arguments, I ended up finding out that she was having an affair. I was very sad, upset, devastated because I never ever thought she could possibly do something like that to me, but then I found out that the main reason she did not want to have a child with me is because she was seeing with her daughters father and she got pregnant from him one more!!!!!!!
We were still together and we tried to talk thru all of the happenings and she said she was very sorry, that it was a mistake, etc. We tried to work things out specially because her daughter really liked me and there was a connection there, they were my family. I still could not stop thinking about what happened. Then, around September'14/October'14 I decided to move out of our apartment and started living with my uncle but kept on going there daily and was still responsible of the financial aspect since my ex-wife was not working. During that time, I met an old college friend at a coffee store whom I had not seen for a while. We got to talk about her and my life, etc... and kept on meeting since then. One time, she expressed to me that she had feelings for me and that she wanted to help me go thru the though situation I was going thru...long story short, we rush a bit and she got pregnant of me. My first son was born in Sept 2015, and I filled out the I751 jointly with my ex-wife back in Mar 2015 and got my GC conditions removed in Dec 2015. I filed for divorce in Mar-2016 and got the official divorce on June 2016. I then got married with my son's mother, my current wife now. We now have 2 beautiful children and another one in the way.
I went to my N400 interview on 12/6/2018 and passed the civics test, English test, and all the history/questions items. However, after taking all the tests and passing it, the IO asked me about my son and what happened since he is not my ex-wife's child and he was born during our marriage. Then I explained all of the above, and she asked me when did I separate and I answered around Sep/Oct, she then told me that I was not together for 2 years with my previous wife and I told her that I was still going back and fourth and responsible for all the finances, that it was a very difficult situation and we were trying to work some things out. She told me, that is not the same as living in the same place, she asked me foe my divorce decree, I gave it to her, she asked me for my children brith certificates, I provided to her, she made copies of all of them. Finally, she asked me for the divorce papers but I did not bring that package with me. She then gave me the paper saying that I passed the civics, English, and history items, but that I needed to provide more evidence, the IO told me verbally that she will be requesting the divorce papers from me. I should be receiving the N-14 any time from the data of the interview and that they have up to 120 days to do so.
I am terribly worried now, the reason is because the IO mentioned that I was not together for 2 years with my ex-wife based on the date I told her we separated and we filed the I750 jointly and got my GC conditions removed. I am going to be sending the divorce papers as soon as I receive the N-14 in the mail.
Again, I am really worried now because I do not know what will happen, I've read lot of post were people say I may get my GC removed because I was not with my ex-wife for 2 years and I could even face deportation proceedings. PLEASE HELP, let me know anything you thing could be helpful in this situation.
