Need insights, suggestions - EAD/AP pending since Oct 2017
Hi All
I could really use some help and insights. I have an F2A EAD case, we filed I-485, I-765 and I-131 in Oct 2017. PD is July 25 2017 and current since Sep of this year.
I am based in Seattle and my case is at NBC. Here is my status
I-485 Fingerprints received
EAD/AP - application received
I have called the USCIS office countless times. Last response in Sep - wait for a decision shortly.
I have raised to Senator, Congresswoman and even Ombudsman. Nothing, same response (different text) that wait for a decision till underlying eligibility is confirmed or that your constituent filed using Date of Filing chart. Ombudsman office hasn't even heard back after 45 days of sending an inquiry to USCIS.
At this point, I am out of options and beyond exhausted. All I keep getting told is to wait. I am on H1B but due to some risk, looking at opportunities and interviewing with another company and would need EAD. It's a great opportunity and I would hate to lose. I had thought, I would have my EAD by now. My lawyer hasn't been much help except lament the delays. He says one option is to litigate and file a complaint against USCIS (I will spend about $2.5k on that). I wonder if anything will come off it or if it can backfire.
I wanted to ask if anyone here waiting has been this long for EAD/AP? Has anyone used the litigation option and had any success? Thanks folks for any insights.
