Concurrent filing I-130 & I-485
- Proper concurrent filing 11/2016 for i-130& i-485
- ( sponsor/spouse is a US citizen & beneficiary entered legally ( overstayed the F1 status ) , PLUS two US citizen children !
- Interview successfully completed 11/28/18 Miami FL ( went very pleasantly without a glitch , but no decision on the spot as for some others , plenty of properly organized evidences were presented , and whatever then IO asked to keep was left with IO )
Finally , 12/22/2018 , notice received for an approved i-130 , BUT also says " it is understood that the beneficiary is in the US and wishes to adjust status to lawful permanent.......a visa is not currently available at this time , once visa becomes available ..etc..."
Has anyone experienced that ? I was under the impression that spouses of US citizens , unless having entered illegally , are exempt from waiting for an available visa or the 245(i) ..IF concurrent filing is properly applicable , shouldn't the results for both i130 &i485 be rendered at the same time ?
Online status for 485 shows " Interview completed and must be reviewed " same for the i-130 despite receiving an approval for the i-130 . Comments are appreciated , and best of luck to everyone .
