My fiancé came with an H2B visa and he’s currently working in Texas while I live in California. We’re getting married in a couple of weeks and he’s moving to California with me. His H2B expires on December 15, and I’m currently waiting for my naturalization interview, which will approximately be around February or March 2020. Our lawyer told me he can overstay his visa and once I become a citizen the overstay will be waived. My only question is what kind of evidence does USCIS ask for? Should we open a joint bank account as soon as we get married or should I wait until I become a citizen and start the I-485 process?
