Hello all,

So me and my wife did our interview on the 29th of August at federal plaza, New York. She is the petitioner - USC and I am the alien. We got married last year November, but when filing her tax returns, she filed as single. This is because I don't have an EAD yet - even till now after an interview has been done I haven't gotten an EAD. During our interview she missed 2 questions but got some other questions, but the big issue here is that the IO asked my wife how she filed her tax returns and my wife was truthful about it. The IO then told us he would not approve until my wife informs the government and changes the status in her tax record as married.

This is now complicated for us and we are so scared right now because she could go to jail for changing it (it would be an admittance of fraud). However, I asked a lawyer who told me the IO was just bluffing and that he can't know if my wife has changed her relationship status on her tax record or not cause only the IRS are authorized to view people's tax records. The lawyer told us to wait on a response from USCIS. We were told they will get back to us within 130 days and gave us a white paper.

PLEASE I NEED ADVISE. We intend to filed a joint tax returns this time around if I get my EAD before the filing season.
