Miami 485 exprience and timeline
Not sure if anyone has had such an experience with such timeline :
Miami Office ( Concurrent filing for 1-130 & I-485 )
- November 2016 submittal
- November 2018 Interview date ( went very well but nothing approved on spot )
- December 2018 Approval letter for I-130 ( approved but says beneficiary must wait for visa to be available even though the filing is concurrent which means that beneficiary should not be subject to visa availability .. ok we thought tis just a mistake , waited)
- February 2019 : received an RFE for a " dismissed " misdemeanor from 2002 !
- Sent the requested info for the RFE ..on time via Fedex
- Waiting .. nothing ...
- On line : !-130 shows nothing about approval letter , it says interview completed case must be reviewed !!
- On line :I-485 shows nothing about receipt of requested material for the RFE , it still shows " on February 25th , 2019 we sent you request for material ..etc.."
- November 2019 , contacted that state senator for help , got a response saying that it might take up tp six weeks for federal agencies to respond ...OK
- Today , received response from the State Senators office copying me on the USCIS' s response to the senators office . saying "
" USCIS records indicate that your constituent’s application is currently in queue awaiting an interview date. Once an interview date becomes available and they are scheduled for an interview, we will notify them by mail at the address on file...."
No mention of the fact that we already had our interview over a year ago, or if it is a " Stokes " or not , or mention the approved I-130 or anything else , just that they will notify when a date is available !!! THREE YEARS LATER . Info on line still to this day hasn't changed or updated since February of this year ! Talk about being befuddled !! Our lawyer tells me that the Miami office is overburdened and disorganized .. wether it is that or not it seem that there is nothing to do other than continue to wait ! Hopefully other Miami filers are fairing better , and for who has been waiting endlessly , you are not alone !!
