Stuck - security checks pending
My case has been stuck forever, response for my "outside of normal processing time" inquiry was
"Your case is currently delayed because the required security checks are still pending. We cannot make a decision on your case until we receive the results of these security checks."
Timeline:
- I-486 confirmation receipt: 10/16/17 (filed in NSC) (Over 2 years)
- Interview 6/11/18 (NY Field Office) (Over 1.5 year)
- EB-2 based
- "Other" changeability (not one of slow-track countries)
- Asian name (non-middle eastern), no conviction anywhere in the world of any kind, not even a parking ticket in the USA
- It has blown through Out-of-Normal-Processing times for both NSC and NY, the ONPT inquiry was filed with NY in Aug 2019
I have tried everything except Writ of Mandamus:
- Wrote to Senator, USCIS response to the Senator's office was "A file was missing and will adjudicate when this file comes back." I assume that this could be the security check result
- Out of Normal Processing time inquiry (see above)
- I am represented by a lawyer, and paid for 2nd/3rd/4th/5th opinions and no one had any good strategy to resolve this. One lawyer suggested that the actual reason may or may not be security check-could be just an excuse.
I would appreciate anyone who has a similar experience, or have heard how this was resolved posts here.
