Rejected I-485 and HSI visit
We filed in mid Sep 2019 and before the end of the month received confirmation letters. The beginning of October my husband received a appointment date for BIOMETRICS and completed the BIO end of October. In the beginning of Nov we received a letter that the case was rejected for insufficient funds. All thanks to our laywer who's check bounced. My learning experience, write your own money order to immigration and if you are not sure how to fill out the money order ask your lawyer. The lawyer immediately re-filed the 2nd week of Nov. We received new confirmation letters the beginning of Jan 2020.

HSI --> They came to our home 6:36 am. I had just left the house to go to work but luckily I was only around the block. I actually saw HSI headed towards my apartment. They had parked atleast a block away three in number. When I circled back home 2 were at the front door one was at the back. My husband let them in. They let him go and put on some clothes. They looked around the entire apartment, closets too. They asked him questions, does anyone else live here, how long have you lived here (I wasnt there yet). They wanted to see proof that he was filing his I-485. When I came in I quickly found the paper work they wanted. One officer asked, so you recently filed this month. I briefly explained the situation with the insufficient funds and lawyer. The officers were nodding with me like they understood exactly what I was saying. They asked me when we got married and what was our lawyers name. They also asked if we were switching to a new lawyer. Then we showed the confirmations from when we originally filed in Sep, which was perfect since it made my whole statement accurate. After that they were done. Since I walked in on the middle of it all, I did inquire what it was all about. The response was, his visa was expired so he was in the US illegally. They wanted to ensure the case was still in-progress and if it wasnt in-progress or if it gets rejected they would summit him for a court hearing (basically immigration prison until the court date comes.)

So to me it seems like we were basically red-flagged since our original petition was rejected and we had to refile (red flag for a scam). Our lawyer ensures us that the payment issue wont happen again, but we're waiting ducks. And it also seems like when things go wrong with immigration the process goes slower.

My major concern is: Making sure the check clears that the lawyer wrote this time. When we initially had the lawyer re-file we did not think it would take this long to get another notice from immigration. Im wondering if the visit from HSI was part of the process in moving the file forward.

We are still praying and hoping for the best.
