I485 Denail cause USCIS has NO JURISDICTION
I need NEED HELP my fellow members ASAP.
I got this letter from USCIS regarding my I485 application thru marriage. I was TOTAL BLOWN AWAY on the letter and the reasoning behind the denial.
I had entered the USA without inspection when I was 11 or 12. Been in the USA ever since with no criminal history till present. But through all those years I have a deportation order on my name. I decided to apply for a travel document. I traveled out the USA for a few days and I traveled back to the USA and went through Border patrol. With that I got my passport and my travel document stamped with “’parole”. With that I legally entered the USA. After that I filed my I-485 application. I went to my interview January 10th. Interview was short and quick. So after a few days of waiting I received this DENIAL LETTER and their reasoning SHOCKED ME.
USCIS reason:
"Since you were not an arriving alien before your departure from the US, you cannot be deemed an arriving alien upon your return to the Untied States. See MTINA. Therefore, because you are not an arriving alien and you remain subject to a removal order that was neither terminated nor concluded with your removal or departure under an order of Deportation or Removal , USCIS does not have jurisdiction over your application for adjustment of status . Based on the above reasons, your application is denied. You MAY NOT APPEAL this decision”.
Fellow Members PLEASE HELP ME and tell me what to do. I have an attorney for my I485 case but I need to hear from any members who has experienced this and know how to solve this issue smh. ALL experiences and advices helps. PLEASE HELP GUYS
