USCIS error denied my green card application
Hello everyone.
I need help/advice sinse my wife and I are not getting it from our lawyer.
We got married a year and a half ago, she is a US citizen.
We filled out all the paperwork I got my work permit 4 months later.
Interview scheduled for September 2019 on a day our lawyer could not attend because of what he said was conflict of schedule with a different case he had.
He sent a request to reschedule the interview, turns out he could not attend because of a Jewish holiday Rosh Hashana.
Long story short 3.5 months later- few days ago we receive a letter in the mail that our application was denied falsely claiming that i went to the September interview and testified under oath that my wife was not gonna show up.
My work permit was cancelled and i have to quit my job.
Our lawyer who got us into this situation in the first place recommended to file a SUA SPONTE motion to reopen the case, sinse him myself or my wife were not present at the interview.
We went to a different lawyer for a consultation who recommends we re-file from the beggining.
I know its a messed up situation but we never went thru this process before and have obviously received a bad legal opinion from our attorney.
Anybody with a similar experience or knowledge that can advise?
