Hello, I am married to USC and got a RFE for my husband Tax documentation. The reason my husband did not file for 2018 last year was because we got married in 2018 and he did not want to file as single while we pending status change. I do not have a SSN or EAD and his tax officer said I will need to have that for him to file as married. Have any one been in similar situation and do you have any ideas on what I need to do.
We do not him filing as single to then be the reason for the denial and they also require this? should we just file as single and attach a letter explaining this ordeal?
