I just wanted to share my experience with you all since my case was a little bit more complicated than the usual. My wife “American citizen” and I have been together for about 5 years but only married for 1 year so far, we have a 3 year old boy together. 100% Legit...

I came to the U.S as a student, then I started a family because God or whatever you want to call it had a plan for me and my family. Summer of 2019, I stopped going to school so, I started preparing myself to apply for Green Card so I can be here for my wife and son, getting all the paperwork necessary together, fees and a good lawyer as well.

I found a good lawyer sometime in June 2019, we discussed his fees which came out to $1500 and we went from there. He told me to bring him all the documents required by USCIS which took me about a month or so since I didn’t have everything in hand at that time. We also needed a sponsor since my wife couldn’t qualify with how much she makes yearly. Her father ended up being my sponsor and luckily it worked, but here where the complication comes in a play.

Back in 2017, my wife and I had an altercation which then escalated to a physical fight, our son “7 months old at that time” was asleep in his room. However, my wife was only charged with domestic violence, and I was charged with the same plus delinquency of a minor, NO HARM TO THE BABY WHATSOEVER but I see the point. Both of us then took DV classes and as well as parenting classes, we are now far better then ever since that night. Case is dismissed!

However, my lawyer requested me to go get a police report and a court disposition to take it with me to the interview. October 17, 2019 my case was received by USCIS, January 11, 2020 was the interview. We only took documents with our names on it, car insurance, bank account and so on and so forth, no pictures as the lawyer argued that pictures won’t be enough evidence.

At the interview, the officer was extremely friendly which gave me a lot of comfort. He didn’t really ask much besides, how did you guys meet, asked me my birthdate, then asked her birthdate, tried to figure out my timeline the whole time I was in the U.S, yes/no questions, then asked about my record. I was completely honest and told him everything from A to Z. Now he has no doubt about our marriage and even asked if we need to keep some of the documents

Result came out to further review to determine whether my charges fall into the CIMT category “Crime Involves Moral Turpitude.” However, he said that he doesn’t see any reason to deny my case, and I will either get an approval or a waiver I-601. On March 2, 2020 I got an update…. Oh God, what is it???? Card is being produced!!

I’m so grateful, happy, and excited for a new chapter. I am ashamed to share this with you, but I thought it might be useful for some of you who was charged with a misdemeanor. I spent days and nights looking up my charge codes but couldn’t really find anything helpful.
