Advance parol Denied due to Student visa was fraudulently obtained
Hey Guys
My Advance parole was denying though still have my 1-765 renewal pending and I-485 still going through background check since last year after interview around june
Reason for denial states.
“USCIS records indicate you entered the country xx xx 2017 using a student visa that was fraudulently ontained. Because you may be inadmissible for procuring an Immigration benefits by fraud and misrepresentation, USCIS will not issue you and APD”
I came into the country as F1 in 2014
I went home on a break December 2015
Remembered my visa while home though it hasn’t expired but can be renewed if it’s 6months to expiration.
I graduated in 2016
Got my OPT
Updated my 1-20 and travel in 2017 for an emergency while on OPT, student service said I could travel as I’m still on status and currently on my OPT
Spent just a week and on arribal at the Point of entry the only questions asked was
We do you work
How much are you paid
Do you like it
That’s all
Am surprise years after my visa is considered obtained fraudulently
Please guys has anyone encountered this or know of anyone with similar cases. Am not really bothered about the Advance parole Koz with the whole virus it’s not safe to travel.
But just wondering if this is the reason my background check sent clear after almost a year we had our interview.
My interview was Marriage bad currently have a EAD to expire in June and I have a renewal submitted already.
Kindly help guys.
