NYC Marriage Green Card Experience with Rescheduling**
Hello everyone!
My husband and I have finally finished the application and interview process for his green card, and I thought to share my experience for those who may have went through similar circumstances. I hope this helps y'all!
He entered the US under the visa waiver program through Ireland, and overstayed his visa by over a year at the time of our marriage/USCIS application. We did not seek legal assistance, and we were able to do everything entirely ourselves, it was a lot of paperwork but it is definitely doable! Organization is key.
We are based in Queens, NYC, however due to some infrastructure/flooding issue at the Queens Field Office, our case was redirected to the Manhattan Field Office for review. I'm not sure if this was the cause of waiting longer than what other NYC residents experienced, but it is likely!
Also, this might be something not a lot of people were able to do, but when we finally received our interview notice it collided with dates I had for an international graduate intensive study trip in Cuba. Long story short I tried to estimate when to hear back by USCIS using the "processing times" on their webpage. It's totally unreliable...
I already had paid the finances that were non-refundable, but when we called USCIS National Customer Service Center, they took our information over the phone to submit a request for rescheduling and we would be notified once approved. We didn't hear back or got a letter in the mail (which NCSC said we would get) so we made an Info Pass appointment to meet with someone at our field office. The representative assured us that as long as we provided proof that I was out of the country and my husband still attends in person without me, we would not be denied for not appearing. Apparently NCSC and the Field office have no direct link when it comes to rescheduling/contacting about case status. My husband went the day of our interview at the scheduled time, and the representative took our proof and gave him a stamped copy confirming he was present that day. We would be notified in the future of when the rescheduled date would occur. We waited... and waited.. and waited. After 3 months we made another InfoPass appointment but they told us all we could do was to wait. We finally got the rescheduling in the mail a few days after that appointment - perhaps we woke someone up with our visit! We received the letter which indicated a new date 2 weeks later.
During the rescheduling process, it's important to know that nothing will be updated on the personalized USCIS check your case status page. It basically stays in limbo after the 1st interview is granted until the decision is made on the application.
Below is a timeline of our experience:
11/06/14 Packet (I-485, I-130, I-131, I-693, I-864, I-765) mailed out officially to USCIS
11/10/14 Packet delivered by USCIS
11/17/14 Checks cashed by USCIS
11/17/14 Email of acceptance confirmation from USCIS
12/02/14 Biometrics scheduled date
12/9/15 Received Text message from USCIS of interview scheduling to be in process
1/16/15 Received Text message of approval of work authorization
1/16/15 Received text approval of travel document
1/23/15 Received email of mailing work authorization card
4/27/15 Received email about interview scheduling
4/29/15 Received letter about interview on May 28
5/28/15 Spouse attends interview and asks for rescheduling
8/24/15 Paper letter for rescheduling granted on 9/10/2015
9/10/15 interview date
9/12/15 Email notification I-485 green card production in process!!
9/14/15 Email approval of I-131 and I-485!!
It was a long process that felt like it would be never ending, but I encourage people who do not have wild circumstances to submit the application on their own. You will save a lot of money in the long run, and I used many of the resources on this website and read the instructions from the forms. My husband fortunately did not have any extenuating circumstances (no crime, legal issues, or health problems), which made our application straight forward.
