Houston Filers, Case at NBC (MSC receipt)
Hi guys,

Just wanted to share our experience and what we've learned about the process so far:

We filed our I-130/I-485 concurrently from Houston with a PD of July 1, 2015. We've been waiting for an interview notice, like many of you. After we passed the 6-month delay window per the last published Houston office data, we called a level II rep, and were told that our case is currently hanging out at the NBC (National Benefits Center).

Interestingly, the rep insisted that since the NBC does NOT publish I-130/1-485 processing dates, he could not give us any idea of when our case would be ready for interview. He also added that we should not be looking at the Houston office processing dates and refused to call our case "outside the processing time", since, again, processing dates from the NBC are not published (this was a frustrating conversation). His advice was to just wait.

This sounded wrong to us, so we looked into it. From what we've read in other forums and immigration lawyer websites (http://immigration-lawyer.com/info/nbc-processing-times-uscis/), the reason the NBC does not publish 1-130/1-485 processing data is because final adjudication is done at the local office (interview, decision for approval or not). Thus, you ARE supposed to use local office dates to determine whether or not your case is outside the normal window (opposite of what the level II rep told us).

Furthermore, we found data based on member experiences in another forum (Visa Journey - http://www. **** *.com/timeline/) suggesting the NBC as of today is currently working on I-130s with PD/NOA1 dates from Sept 6, 2015, meaning our application was likely already been processed a while ago, and is waiting for the Houston office to request it for an interview (which, given the last published 6-month delay, should have been this past week). We haven't received any RFEs, or indication that our case is otherwise complicated or delayed (biometrics and AP/EAD card arrived in a timely fashion). Given the holidays and the Houston office moving locations, the delay may have increased slightly, but we still called the service number again. The new level II rep asked why we had called twice in one day, then finally agreed to put in a service request for us. We also filed a service request online, no reply from either yet.

We are planning to reach out to a Congressmen after we hear back (as we are not expecting much help from the service requests given everyone else's posts). Have any of you had much luck after reaching out to a Congressman about a pending I-130/I-485 application that is outside the normal window?
