Husband(applicant) to wife(petitioner) whom she is a US citizen, Husband came on a B2 visa, we filed concurrently in September 2015, received NOA receipt from Missouri..All this time we have replied several RFE and RFI, then went went for biometric, last month our case was transferred to Potomac VA Arlington(BEGIN OF PROBLEMS), then 1 month later l-130 approved, BUT sent to NVC for consular process(yet we are are all here) mark you we properly answered question 22 on i130 and sent copy of passport to show we are all here...why did USCIS wait all this long to sent husband away for consular process? wouldn't that mean self deportation now that his status has expired? if husband leaves would he be deporting himself and get a 10 yrs ban stamp on his passport upon arrival? any advice please? we have tried ombudsman no solution, we have tried to call the USCIS offices no help, talk to 2nd tier officers created request, info-pass with no forthcoming solution, we have called NVC they say they are waiting for correspondence from USCIS to request the file be return to USCIS, since its contractor who are handling these cases, however we have called USCIS but they dont act on our case.
AND BY THE WAY HE NEVER RECEIVED EAD card...FOR OVER 8 MONTHS NOW!!!
