I am explaining my case below, and please reply asap.
My labor (priority date Oct 2007) was filed for Project Manager designation and I got my I-140 using this labor. Last december I filed for I-485 and got EAD in Feb 2012. My I-485 is still in process and I am still on H1B.
I am working as a consultant at client site. Client is offering me permanent job as a senior developer. I talked with their attorney and he is telling that AC21 is not possible in this case as job designation and responsibilities are different. He is saying that I can still join them on H1B and my EAD/I-485 will not be cancelled. After joining they will file new labor and I-140 for me and will port the old priority date. He assured me that my EAD/I-485 will be safe and my wife can continue to work on EAD until getting GC.
I am not able to digest all this information, as from all the forums what I read is that job could only be changed using AC21.
Please suggest.
