I am in the process of filing I-864 for my husband. I have a few questions which I am really confused about. My husband had temporary work visa, so we both worked and filed joint tax return last year. We have sufficient income as per the household/income requirement for the last year. However, i am unemployed now, so is my husband. While filing I-864, what income should I report ? The Adjusted Gross Income from last year's tax return ? Also, what do I write as current income, in Part 6 #5 ? Is recent pay stub necessary ? Otherwise, I will have to find a Joint Sponsor for filing the form. In thIe meantime, I got a mail from NVC to make payment for the AOS. So, do I send the I-864 to the NVC and not along with I-485 ? Thanks all, in advance.

All I can tell you is that my husband is self employed and was not making enough on his tax return to file the affidavit of support by himself. We had to get his dad to co sponsor me. We had a lawyer at the time and she basically said that if we don't get a cosponsor we will not be able to file as the application will be rejected on that basis. I would get an immigration lawyer to take you through this part. Complicated stuff.

Thank you Sonata0506 for your response. It is, in fact, complicated. I know I will have to look for co-sponsorship. But in my case, I had enough to meet the income requirement in the last year's(2012) return. However, from Feb 2013, I am unemployed and I don't know if the figure on last year's return is enough or I must have a current job and will have to submit evidence of that. Anyway, I think i will look for a lawyer's help in this case.
