I just received a Request for Initial Evidence in re: my AoS application submitted at the end of July (filed concurrently with Petition for Alien Relative). The application package included tax returns for the years 2010 and 2011, together with copies of corresponding Forms 1099-MISC (2010, 2011), and a copy of Form W-2 for the year 2012, showing that the petitioner (my husband) has sufficient income. We were unable to include the most recent federal tax return because he had applied for automatic extension and is not due to file until October. We attached his handwritten letter explaining the situation, as well as copies of pay stubs for the most recent two months (June and July), and a copy of the employment offer for his current job (dated September 2012).
Based on submitted evidence, USCIS could not determine whether the petitioner/sponsor has sufficient income, and therefore requested additional proof. In response to the RFE, we are planning to submit bank receipts for the last 12 months (which show sufficient regular income, as well as all deposits and withdrawals) and proof of assets including most recent CDs, SEP IRAs and 401(K) statements totalling $50,000+. Would that normally be considered sufficient proof that current income is above 125% of the federal poverty line?
I tried to get some advice from USCIS but after 99 minutes on hold all they did was refer me to their website for a list of licensed attorneys or accredited representatives. At this point, however, I would much prefer a second opinion from a fellow forum user.
