  • I-864 affidavit of support question, PLEASE HELP!

    I'm a phd student with F1 visa. My fiancé is US citizen and we plan to get married in the city hall this week and start the green card application for me.

    I have a few questions referring the affidavit of support:

    1. Since my fiancé is also a student for the last 5 years, his income, including the school scholarship and some gig payments by personal checks, doesn't meet the poverty guideline threshold. He also never file the tax because the income is less than the lowest amount required to file the tax. He has no loan. He does have some musical instruments (cellos and bows) that worth $100,000 that can be certificated and about 20,000 saving.

    Can those be counted as "assets"? Will this no tax-filing thing severely affect the application even considering that his income is not enough to be eligible for tax filling? If yes, what shall we do to fix this?

    I do have a school scholarship of $30,000/yr but we won't be married for over 6 months when we apply so I think that can't be added. Am I correct?

    2. We definitely are having his parents (both work for government and his dad is in military) as our co-sponsors. But I also heard that my fiancé is the major sponsor. How can the cosponsor conditions compensate for the fact that the main sponsor doesn't have enough income?

    3. Currently we don't plan to spend a lot money on reception because it doesn't make sense financially. Is a wedding reception and the evidences from the reception necessary for the application? We are now having same apt address and will do the joint bank account. So by the time of application, I don't know if there will be a lot "evidences" for us to prove it's real. In this context, is the reception necessary?

    I think you'll be fine.
    1. Do a court marriage its like $100. You dont need a reception or anything, why because you dont have money, you can be honest & say that.
    2. File all the papers get anything & everything you can to show the money you have. You guys are students so its ok not have too much money. My friends from college both doing bachelors got married & got GC & are happily working today.

    So bottom line, get married, show you guys are good students, with good grades, scholarships, etc etc. Also family vacations, testimonials, joint lease, cell phone bills, bank accounts, etc etc. Most important of all show you are in love ! You'll be fine !!!
