I-797C Rejection Question

Hi!

My spouse and I sent a green card (thru marriage) application (Forms I-485 and I-130).

We received the I-797C Form of Action notice as Rejected since I signed one of the forms in an incorrect place.

When re-submitting the I-130 form, for question D2 (Have you ever before filed a petition for this or any other alien?), do I now have to answer Yes?


Any help and info you have is greatly appreciated! Thank you!

Since your first submittal was a rejection, it does not count as a completed submittal.

I would still report, however, that a submittal was made, but rejected for an incomplete form.
