  • 7 months sice I had the interview, no answer yet

    I came to the USA on F1 Visa in 2007.
    Graduated in 2009 with master degree.
    Worked from 2009 to 2012 on H1B.
    Got laid off in Sept-2012.
    Got married in Jan 2013, my wife is a USA citizen.
    Had my interview on May-10-2013 in the Cleveland office.

    The officer asked me a few identity questions only for a few minutes and nothing about the marriage, then he asked me to leave the room, he spent more than 30 mins with my wife, he asked her all kinda stuff. At the end of the interview he told her that he will let us know in a few days and he will send us a letter. It has been more than 7 months and we never heard back from them, my lawer said there were no issues at the interview, he sent a few inquires and always the response is the same "pending, security check".

    Can you please advise and tell me whats going on, especially that the office separated us in the interview and never asked me any questions related to our marriage, he just asked my wife. Kinda confused over here.

    What is your nationality? That has a large influence on special treatment of any immigration procedure you submit.

    On almost every visa petition I submit for Afghan nationals, either the beneficiary or the petitioner is asked to go to a local USCIS office for a special interview or to call the Kabul U.S. Embassy. One of my Afhan clients in Switzerland had his fiancee visa held up for months, then denied, because his background couldn't be successfully investigated in Kabul (while he was in Switzerland).

    On the other hand, significant age differences or prior immigration processing either your wife or you has attempted might have prompted this delay.

      I am Palestinian Arabic muslim. My wife is 20 and I'm 30. I never had immigration issues.

      Is there anything I can do so they proceed in my case?

      Also, what does it mean that the officer only questioned my wife about the marriage and did not ask me not even one question about our marriage, is it good or bad?

        Taylor,

        I can only speculate based on anecdotal experiences from people with whom I worked, so don't take my opinion as gospel.

        I believe that applicants who are clearly from Muslim countries are the victims of over-zealous interviewers who are looking for "political" indications.

        The lack of questions to you about the marriage, when the interviewer questioned your wife at length, has me puzzled, also. He may have been looking for weakness in your wife's sincerity about the relationship, i.e., a "straw" marriage of convenience. On the other hand, he may have been interviewing your wife at greater length because she is the petitioner and was the most likely to be insecure about any problems found in the paperwork.

        Another perspective of a "longer" interview with the petitioner that I observed years ago at a Los Angeles INS waiting room was of an Ameican guy who was adjusting the status of his new wife from El Salvador. Their experience was comparable to what you had, in that they barely talked to the applicant, but interviewed the petitioner in private for a longer time. When the petitioner came out of the interview, I got the impression he was given a "worst case" description of how intercountry and interethnic relationships are suspect and might not last.

          He'll rayb please I need to ask a few questions, cos am on my AOS am married to a USC , who works in my country Nigeria , I met him last year on my first visit to the Us on conference , we meet at the airport in the Us and became friend at that time I was still married , and he was going through he's divorce , while I was having problem with my marriage etc but now we are married and he filed my case at the end of July , we didn't know we were going to get married we just went to the court and got married not planned cos he just wanted to find out some details and decided to get marry that day we weren't even dressed so he was just me and him , so we filled and I got priority date for august 8 so far have gotten my EAD and AP on October 16 2013 and since then my status has been on testing and interview, have been ready post of people that were august filler and most of them have gotten their GC am just worried cos I don't what's working it been almost 2 month since my EAD and my biometrics was September 11, wondering if you can help since your we experience am from orlando Florida thanks

            Ramz,

            If your Adjustment package was submitted in August, it's too soon to be overly concerned about there being anything wrong with the paperwork.

            Wait at least two more months before making any inquiries about status, if you haven't received notice of an interview date by then.

              Thank you again, I just hope it works out. I am afraid that they just leave my file on shelf for years for no reason, it is stressful process and I hope they do their job.
