  • timeline for getting i485 receipt notice -

    hello,
how long does it take to get a receipt notice after the fee for i485 has been deducted.i applied it in first week september..and the fee just got deducted..not sure if it is because due to the recent news that USCIS had stopped accepting application for sep 2014.

also, what is the reason behind keep may 1 2009 as current until oct 2014 but then stop accepting applications for september on sep 10th..

    Wendy,

The I-485 hardcopy receipt Notice of Action usually shows up about 3 or 4 weeks after USCIS receives your I-485 package.

Your other commends about USCIS stopped "accepting application for sep 2014," etc., does not reflect my recent experience in submitting I-485 packages for several clients in September already.

If your relative (or you) is eligible for immediate visa processing (spouse, parent or child under 21 of a petitioning U.S. citizen), there is no delay in processing of your Adjustment package. If you do not fit the above criteria, yoru I-485 package and fee may be returned to you because your Priority Date might not be current.

      hello ray ..
      thanks
i seem to fit in the criteria that you had mentioned.
in my case, it is for a minor dependent, indian citizen, applied during first week of this september...pd is marchl 2009.....parents had just received the green card...so, how long is the wait expected for minor dependent to get the GC..

Assuming all other eligible criteria is met, the child's Adjustment of Status procedure should be completed in approximately 6 months, and his hardcopy receipt should arrive in 3-4 weeks after the I-485 package was submitted.

          thanks again..
also..we had applied for his AP along with the i485 application since we also need to make a trip to home country end of this year and is something cannot be avoided..in case if we dont get the AP by then before our travel..can we travel and reenter using the i485 receipt notice..(as he might have lost his h4 by then since primary had received his green card)? will this complicate the issue any further....we are making arrangement to have someone mail the green card/welcome notice to us in case if the green card come through when he is out of the country so that he could travel back on his green card.
do you see any issues with this?

Lots of issues. Most Adjustment (I-485 procedures) packages end up with USCIS interviews. If you miss the interview, the Adjustment is denied and you lost the fees. Also, you cannot use an I-485 receipt to reenter the U.S. The absence of an Advance Parole will be considered abandonment of your Adjustment processing.

              I-485

Greetings, I am just wandering how long it takes to get the proper form or green card so that my husband can get his social security card. We were married in October and filed all the paperwork for the I-130 and I-485. He has done his prints as well as our interview. That was April 21,2015. It was approved and he was given a piece of paper with his Priority date and it was explained to him about having the conditions removed from his status within 90 days of his priority date. I received the I-797 Notice of Action saying his I-130 was approved and that we were to follow the directions on the notice but there aren't any. We didn't file for a work visa because we didn't realize it could have been done for free until our interview so with all this being said, what kind of time line are we looking at? The notice of action stated that my husband would be notified separately but we still have received nothing.

              Thank you

You can still apply for a temporary EAD but it may take up to 3 months to get it. Otherwise, your Adustment interview will be in about 5 or 6 months from when the I-485 was submitted.

timeline for getting i485 receipt notice

                  Anyone who can answer this
my wife came to the US on april 27 2015 thru a visa waiver program and we just filed the forms i485 and i130 and g325a on the 6th of july. Her vwp expires on the 27th july 2015 and her return ticket is july 23rd 2015, would it be an issue if we dont get the receipt notice by then cuz i read on here that it could take 3 to 4 weeks to get that hard copy in the mail. Im a naturalized citizen. so should i have her stay past the expiration or send her back?

If she came in to the country with inspection (through immigration and her passport is stamped and has an I-94), she should be able to stay without issue past her return date. However, I believe this only applies "IF" she (and you) applied for a change on status. As long as that is done, you should be ok. Register your case on the USCIS website and you should be able to get alerts a few days faster that the hard copy. I agree, having a hard copy is best, but this certainly can put you at ease.

My recommendation is to consult a lawyer. You do not need to retain his services permanently, but do a one time consultation. I did that just so I had my facts straight, and it cost me $150 for an hour of advice. There are also lawyers that would do it for free the first time (I went through one, and then hired him for my case).

                    Good luck.

I have already sent the i-485 and the i-130 with the G-325A for me and my wife in the same packet with money orders for the filing fee for those forms but i submitted it on the 6th of July and some people on here and other places online said that it takes 3-4 weeks to get a reply and so i don't have a case number yet or i assume the case number will be on the receipt notice which i haven't received yet. I did fill out and send a form with the packet to get online and text alerts but no reply in my email or text as well considering it has only been 1 week. My only concern is that i will not get a receipt notice from USCIS till after her stay expires on July 27th and worse if they deny the application because one reason or another and then she has overstayed her approved stay in the US.

If the package is rejected (for signature, currency of form or incomplete check), you will just resubmit the package with corrections.

A denial won't come without a "Request for Evidence," usually several weeks into the process.
