  • Filing I-485 with dual citizenship

    Hi all,

My husband and I are filing the I-130 and I-485 concurrently from within the U.S. I am a U.S. citizen and he has dual citizenship in the Dominican Republic and Brazil. He was born in the D.R., but automatically became a Brazilian citizen because his mother is Brazilian. He has a Brazilian passport and his B-2 visa is on this passport. He does not have a Dominican passport.

Now, he has his Dominican birth certificate but does not have his Brazilian birth certificate because he would have to go to Brazil personally to get it. Can we file the forms with his Dominican birth certificate and his Brazilian passport, or do these documents have to be from the same country?

If we can file with his Dominican birth certificate and Brazilian passport, what should we put as his nationality in the forms?

    Thanks in advance!
