  • Request for Federal Tax Return

    I am working on the adjustment of status for my husband, who is in the US on K-1 Visa. I got a request for additional evidence from USCIS to provide Federal Tax Return for 2014. I have filed and extension with IRS. Would USCIS accept it as an evidence of filed taxes? If I didn't work in 2012, 2013, what kind of a proof I can send?

    Id request a transcripts from IRS for the extension, which should be available I believe its form 4605T - you can call 1-800-829-1040 or visit IRS local office to request the copy.

    I got my tax return transcript via their website http://www.irs.gov/Individuals/Get-Transcript - but I'm not sure if that holds extension transcripts, sign up and give it a shot.

    I should state that yes USCIS "should" accept this as proof, but than again they can say NO, but reasonably speaking - I see no doubt that they should not. However, it just shows that there may be financial instability on your end :c and may question things if you are your husbands financial supporter.

      An extension request is not evidence of filing a tax return, and will not satisfy USCIS. Any good tax preparer can complete your tax return in about an hour, so your best bet is to get it done and send USCIS a copy of the completed tax return.
