Six months have passed since we were denied I-485 or lack of funds, finally can pay.

  • Six months have passed since we were denied I-485 or lack of funds, finally can pay.

    We are just two travelers, who fell in love in Europe Spring 2013. I overstayed my visa there for a year with no consequences, and he has overstayed his in the U.S. with probably a lot more consequences than I would like to think of at the moment. Sigh. Our story is grand and cheesy. But that is all beside the point. My husband is from Sweden, he came in Sept and we got married in November before his travel waiver visa ran out. Then we filled out the forms all on our own along with a fee waiver which I naively thought would get us through the hoops. Ha! Wow was I wrong. We were promptly denied any further action because of lack of funds....aka $2,000.00 which many of you are familiar with. He is just a musician, I was working in a cafe, we were living broke in Los Angeles. Could barely make our own rent, let alone cough up the cost of immigration paperwork. It has been six months now, and we finally have saved up enough to pay the application fees, have a possible joint sponsor, and are looking into Advocates to help us fill out the paperwork correctly (just to avoid another denial). My question is, are they going to be total *******s about us waiting those six months? Does immigration services have a heart? Is his adjustment of status completely hopeless?? Would appreciate any advice or shared experiences!

    Normally, a resubmital of the Adjustment of Status, correctly completed and with proper fees, will get accepted.

    Just make sure you have the following, besides the basic forms:

    1. $420 for I-130 fee, separate from $1,070 for I-485 fee.
    2. Immigrant medical exam on form I-693 in sealed envelope, completed less than a year ao.
    3. Have someone with experience check your forms and complete package before you submit it.

      Thanks for responding Ray. We have since left Los Angeles (were living in Filipinotown!). Now on the countryside in Louisiana, headed to New Orleans in a month to start life out there. Really appreciate the insight!

        I spent my high school years in the "Filipinotown" are of L.A., around Temple and Rampart areas. It's not the safest area these days.

        When you submit your next Adjustment package, make sure you use an address at which you can receive mail throughout the waiting period.

          Fee waivers are always denied for adjustment applications requiring financial support. http://www.uscis.gov/sites/default/f...eeSchedule.pdf

          No immigration agent is as sweet as Ray B, but they will not give him a hard time for waiting to apply.

            I had forgotten that fee waiver exception. A lot of people, already convinced that government agencies are sympathetic to personal financial problems, will routinely expect fee waiver requests to be approved, only to find that USCIS doesn't like to approve such waivers, for even the most needy applicants.
