  • Help with I-485

    Hello, I would like some information.
    I came to the usa on tourist Visa Oct 2002 and married a us citizen in December 2002. We called the Immigration center and were told we had to file the I-130 wich we did in Jan 2003.
    Now I found out I am being processed as living in the Netherlands! No one ever told us to file the I-485! I just got of the phone with the us embassy in the Netherlands and I am scared... she told me I am basically illegal in the usa and they can denie my I-485 when I file for it now.
    I did not break any laws while here, didn't even work cause I was told by the Immigration center I couldn't ( later I found out I could).
    I have gotten nothing but wrong answers from either the immigration center or the Nation Visa center.
    Does anyone have any experience with filing a I-485 after 3 years?
    I am aware that it will probaly take more then a year for the I-485 to be processed and that we will have to start all over again.

    File your I-485 with I-130 receipt or approval notice. As long as your marriage is still valid and in good faith, should not be a problem.
