Hi guys,

I'm married with green card holder and we r planning to apply the i-130 now in Dec!
My question to you is, after my i-130 is aproved, can i travel to the states with tourist visa and adjust the status of my visa?I mean apply for i-485?
And till my date is current, can i apply for employment card as well?

Since your Priority Date won't be reachable for close to two years afrer the I-130 is submitted, don't submit your I-485 until your Priority Date is reachable for your visa class (spouse of a Permanent Resident).

I've heard that each case is different , depending on the nationality as well!
Are u saying that by the time we apply for i-130 and the time is approved it can take 2 years?

The waiting period depends on your country. In which country are you being processed, and which is your nationality?

Using a visitor visa with intent to remain in the U.S. to be processed for immigrant status is not a valid basis for applying for a visitor visa. Any mention of an I-130 in process may be perceived as "intent to circumvent normal immigration requirements," a routine reason for a visa denial.

Having said that, however, if you are allowed to use a visitor visa to enter the U.S., wait 30-60 days, then submit your Adjustment of Status package.

I already have a tourist visa issued in 2012 for 10 years and i visited USA many times and i have never over stayed!So i guess it won't be a big problem!

And another thing pls,!
After i adjust my visa status, can i apply for emplyoment card so i can be able to work there?

During your prior visits, you did not have an active I-130 form submitted for you. That is considered an "expression of intent to immigrate," a possible reason to deny your entry.

The I-485 submittal package should also include form I-765 to obtain a temporary Work Authorization before you Adustment proessing is complete, which takes about 6 months.

It's true, i didn't have any petition in pending!When i consulted few lawyers in usa i've been told that when we apply for i-130 i still cam visit my husband and come to usa with work(because i have as well crew visa) because they cannot really say anything as long as i have a job where to come back to!
Do u have ideea how long the i-130 will take till will be approved?Approximately.Thank you so much!

The attorney advice that you would have no problems reentering the U.S. was not 100% reliable. The decision to allow entry is based on the immigration officer's discretion at the Port of Entry.

I-130 approval times vary. If petitioned by a U.S. Green Card holder, completion of processing might take up to 8 months, but continued processing or eligibility for your Adjustment of Status will depend on when your Priority Date is reachable.

I appreciate your answers!I'm aware that it depends on the immigration officers my entry in usa but i can take a risk!I'm not planning to lie with anything or to overstay or be illegal in any way so...i can try!

your I-30 will take minimum 5 months and after waiting so long you need to wait only 3 months more,better to get all your papers ready by the time you get your I-130 approval.and get the appointment for abu dhabi embassy.

I'm on H1B and my wife is not H4(Srilankan born citizen)

My PERM filing date is July 21 2015, Does anyone knows how long does it take to get PERM approved?
Also I would like to know how many months does it take to get 485 thru cross chargeability route.
