Hello everyone. I have been reading this blog for the past few months and it is really nice to hear everyone's experiances. This October (2015) my husband, who is half Swiss, half American, send the i-130 petition for me. We never lived in the States before, but my husband wants to pursue a career in filming so he decided to move to LA. In January, I came to visit him, entering with ESTA/VWP, and help him to find an apartment, with the idea that I will return after 2 months in Europe and wait for my documents to be approved. After a month I decided to stay in the US with him, so I applied for the adjustment of status, before the 90 day limit. The USCIS even send me a week ago a letter that it needs more evidances for the i-485 from my sponsor, etc. However a few days ago we recieved an I-130 approval letter stating the following:
Notice Type : Approval notice
The above petition has been approved.
The petition indicates that the person for whom you are petitioning is in the United States and will apply for adjustment of status. The evidence indicates that he or she is not eligible to file an adjustment of status application. This determination is based on the infomation .... Because the person for whom you are petitioning is not eligible to adjust, we have sent the approved petition to the Department of State National Visa Center. NVC processses all approved immigrant visa which consular post is the appropriate consulate to complete visa processing. NVC will then forward the approved petition to that consulate.
Looks like I-130 is approved but "not eligible to file an adjustment of status application", which I already filed and they demand more evidance for it? I called the nscis and they told me to make an infopass, but when I try to make it, the system tells me that they are fully booked basically. So I am scared if i am residing right now illegally and if I have to reapply for adjustment of status.
