  • I-485 rejected, I-94 expired

    Hi guys,

    Continuation of a massive stress saga that is this immigration process - my I-485 was rejected because it turned out I put the wrong amount in the cheque (I didn't realise that the $85 biometric fee was due at the same time), which I only found out about 2 days ago, and whilst waiting to receive the package back to refile my I-94 has expired. Does anyone know what I should do with this now? Do I need to file the I-130 as well or is it still ok to just file the I-485?

    The I-130 is fine; it's just the I-485. Are you the spouse or parent of a US citizen?

      You cannot "just file" the I-485. You must first get an I-130 Approval Notice of Action or file both the I-130 and I-485 at the same time. But this is assuming you are entitled to "immediate priority" by being the spouse or parent or a U.S. citizen petitioner (for your I-130 approval).
