June Submissions - Concurrent Application (I-130,I-485, I-131, I-765, I-864)

    Hi! Just want to let you know, I?m an AOS filer too from Oakland.
    My PD is 3/30/2018. Did my biometrics last week 5/03/2018.
    According to my lawyer, right now SFO is looking slow. Takes about 9months to 16months. She had a case that took 1 year. So you?re not alone.

    PD was june 23rd 2017

    last update I had was on october 9th 2017 "ready to schedule your interview".

    My field office has waiting time from 14 to 30 months, my EAD expires in october 2018, should I wait longer to renew it?

    Hopefully, others read this. It is illegal for interviewers to ask you about the expiration date on your EAD. There should be no discussion of documents you'll use to prove eligibility for employment authorization or whether you are a conditional permanent resident or have a 10-year green card or have a I-485 pending BEFORE YOU ARE HIRED.

    ONCE YOU ARE HIRED, your employer must give you the Form I-9 and the list of documents that you can present for employment eligibility verification. They can't say "And tomorrow is your first day. Bring your passport and social security card, by the way, we'll send you to HR to fill out all the paperwork." That's illegal and they can face serious fines.

    ALL THAT YOU MAY BE ASKED IS "Will you now or in the future require sponsorship for employment visa status (e.g., H-1B visa status)?" If you'll require the company to commence ("sponsor") an immigration or work permit case in order to employ you, either now or at some point in the future, then you should select Yes. Otherwise, select No. ***This question is legal.***

    If you are a refugee, or are adjusting status through your husband who has a work visa - so you got a EAD; or you're adjusting status based on marriage to a US citizen, etc, YOU WILL ANSWER NO TO THAT QUESTION. That is all you need to say. I get it. You are all excited to have your EAD and are eager to show it and get to work. Well, not so fast. It's ilegal and believe me when I tell you that you will be discriminated against. In your case, you were and they told you without blinking twice - zero remorse.

    So if your EAD expires in October, then you should get started with your renewal - just in case. But that should never be a topic of conversation. If you're hired and you present the EAD that expires in October and they refuse to accept it OR better yet, they ask you or comment they prefer employees with EADs that have longer expiration dates, that is discrimination on the basis of at least 5 protected statuses. It's a huge deal.

    I would get started on renewing the EAD. I've seen others get interviews way faster at that field office. I would call and ask to speak to a level 2 officer. Show no signs of frustration; just concern. See what that gets you.
    Then, you can try pulling the congress card.

    It sounds to me like you are looking at an outdated third party site that shows processing times as of X date. That is no longer the way USCIS reports processing times. See for yourself. Here's the link. https://egov.uscis.gov/processing-times/#mainContent

    Received updates on the tracking website (myaccount.uscis.dhs.gov). The other website (egov.uscis.gov) has not been updated and still stays interview scheduled.
    Tuesday 3/27: Card was being produced and would be mailed to me
    Wednesday 3/28: I1485 and I130 approved
    Thursday 3/29: Card has been mailed

    Completed our interview yesterday, March 22 at the Washington DC field office (Fairfax, VA). Interview was scheduled for 9:45am and we were called by the officer at that time. The interview itself seemed to go well - the application forms were reviewed and basic questions related to each other's demographic information, family information, how we met etc was asked. We were also asked for supporting documentation and provided our joint 2017 tax returns, utility, phone and bank statements. The officer requested our photo albums and reviewed those with us too.     09/21 RFE about husband's LES
    09/29 RFE was received
    10/20 card was mailed to me

    I moved to Colorado right after that, no updates since. It's been 75 days and won't let me make a SR for my I-485. Any Colorado filers?
