  • I-485 Interview date, Lawrence, MA?

    Hello all,
    My wife came here through a Fiance Visa, we got married within 90 days, applied for EAD, Green Card, and AP in August 26 (within 90 days of her arrival). The whole process went really fast and smooth, she already received her EAD/AP card in mail early November of 2016, and since then her status read "Ready to be scheduled for an interview". It keeps getting updated with the same status meaning only date changes, for example, first time it showed "Ready to be scheduled for an interview" on November 1ST, second time was February 2ND, and finally today August 3 "Case is ready to be scheduled for an interview". This is frustrating. It has been on the "Ready" status since November 1st basically so it has been about 9 months.

    Is anyone else waiting for Lawrence, MA office?
    Anyone, please help! I really don't want to renew her EAD since I will have to pay extra money for that, but I guess I will if I have to.

    Thanks!

    It is taking a really long time lately to get interviews almost everywhere. You can try to contact your congressman for help. Also EAD that are family based c(9) are free with pending i-485. So go ahead and renew. Include copies of i-485 receipt and soon to expire EAD. Once you file for renewal your receipt automatically extends your EAD for 180 days.

      Thank you!! I honestly thought we do not qualify to renew unless we pay the full amount. So is there another form for that? If so, what is it? Thanks again!!

          No it is the same form. i-765

          Renewal EAD. If this is a renewal application and you are applying under one of the following categories, a fling fee is
          not required:
          1. (a)(8) Citizen of Micronesia, Marshall Islands, or Palau;
          2. (a)(10) Granted Withholding of Deportation;
          3. (c)(l), (c)(4), or (c)(7) Dependent of certain foreign government, international organization, or NATO personnel;
          4. (c)(9) or (c)(16) Adjustment applicant who applied after July 30, 2007.

              Hi again,
              I know that it says it is free, but can you please check this paragraph? I am confused about first and last parts of the below paragraphs:

              "K-1 Nonimmigrant Fiance(e) of U.S. Citizen or K-2 Dependent--(a)(6). File Form I-765 if you are filing
              within 90 days from the date of entry. This EAD cannot be renewed. Any EAD application other than for a
              replacement must be based on your pending application for adjustment under (c)(9)."

              The last part kind of clarifies our situation, correct?

                    Hi Almargahi,

                    My original field office is Lawrence, too. My PD is March 16, 2017 and at the beginning of April I got the biomatric appointment letter from Lawrence office. In June I got the interview notice from Boston office to inform me my interview date is July 21, and location will be at Boston office. I was a little confused and read the letter carefully and sure it is the Boston office I need to go for the interview. I am not sure if that is because the overload of case in Lawrence office. Maybe you should contact your congressman about your case to see if they can move it to Boston office, will that work? I can't say.

                      Hi, we received the interview date on September 13th, how did yours go? What did you bring with you to the interview? I know that they list the stuff you need to bring, but I am confused about the medical exam, my wife already did this back in Turkey prior to her arrival in the US.

                        How long ago was that? If it was more than a year, then she has to do the medical examination again.

                          I got my green card last week and today I went to apply for social security number. When you receive the notice mail about the interview, there are the list what you should bring, I just follow that and gather as possible as we can.

                          I guess your wife's medical exam will be over one year old by September, then during the interview the officer will request you to submit a new exam report. If your wife go do it again now, you will have that new exam report with you in the interview. If you got all questions/document right at the end of the interview, you might get approve on the spot when new exam report is on the desk; or the officer will ask you to go back and do the new exam then mail to them, it might delay the approval.

                          Just my suggestion, you should make your own decision to do the medical exam now or after the interview.

                          Good luck on your interview!

                            This is what I also thought, BUT it states somewhere that it will still be valid since medical was presented WHEN she applied for I-485, so it should not expire. Or K-1 applicants somehow are excluded. I will have to call USCIS to make sure.

                            Hi and thanks for the response! Are you 100% sure that she has to get examined again? I read somewhere that K-1 applicants were somehow exempt since they submitted the exam at the airport when they arrived, so USCIS office has that report, and they will take it and accept it. I am not really sure at this point, did you also enter as a K-1?

                            Here:

                            "Medical Examination

                            If you received a medical examination prior to admission as a K nonimmigrant, then you are not required to have another medical examination at time of adjustment as long as:

                            Your Form I-485 is filed within 1 year of your overseas medical examination
                            The medical examination did not reveal a Class A medical condition
                            If you did have a Class A medical condition, you received a waiver of inadmissibility and you have complied with the terms and conditions of the waiver"

                              Here:

                              Alright so when have you filed I-485? If the interview falls after 1 year of the I-485 filing, then she needs to do the medical examination. Unless I am not fully understanding the K-1 situation since I have lived here for over 16 years and I entered on a B1/B2 visa.
