Dilemma - DACA EAD and AOS EAD

So as many of you have heard, DACA has been rescinded. Now I read that DACA recipients have until October 5th to submit their renewal applications and it will be good for two years. I have submitted I-765 with my other applications and from my PD of 6/5, I have not heard anything. I submitted a case inquiry 9/2 and it states that is has not been assigned for processing yet.

I am leaning more towards just sticking with the AOS EAD since mine is expiring in January 2018 but can I request for expedite or not really?

Really starting to get anxious with all the hate towards immigrants and the desire of some American people to get all undocumented people deported. Fingers crossed I hear something soon

I don't feel any hate towards immigrants, what Americans don't like anymore is illegal immigration and I can understand that they look at Europe's failed open border policy and see what it has become a once peaceful continent now rattled with terrorism and problems. I am from Germany so trust me I have experience first hand what the illegal immigration has done to my country.
Having said that if you look at the polls most Americans support a resolution for people on DACA in exchange for border security. Which I think is the right way forward.
There are millions of people waiting all around the world IN LINE to come here and it should not be encouraged to just jump a fence and demand amnesty.

With respect to you, you are not in limbo you have a pending AOS so you have a legal status until your case is adjudicated. Also until January is plenty of time you will definitely have your new EAD or even the GC so absolutely no reason to worry you are actually in a very fortunate position most people here have to wait months on end without ANY EAD and you already had one when you applied.

I sure hope you are right. My only issue is that certain American people do not comprehend the difference between those who cross the border and those who come here on a Visa. To them, the only solution is to deport all.

So if my application was taken and I already had the biometrics done, you are certain that I am in legal status? Even though I overstayed my visa (came here in 2001 from PL)? Btw I have always wanted to visit Germany, my dad's brother lives there in Tottenham (I believe).

With all respect to you mustang85635, DACA recipients were not old enough to "just jump a fence and demand amnesty" when they entered this country. There is a lot more to it than that, and a far greater human aspect to all of it. As someone that has entered this country legally, and in the system on a visa for 13 years, and still waiting for a sense of permanency through a green card, I feel your frustration with the processes and timelines. The system is broken and in dire need of a fix. However, DACA recipients are not jumping any lines, in fact, they do not even have a line for a green card like I do, and perhaps you do too. DACA has allowed children that know only of the United States as their home, to live and work here, and go to school. And now, even those basic grants are at risk of being pulled from under their feet. I leave it at that... but I welcome Walbrzyszanka21, cannot begin to imagine the stress and anxiety DACA recipients feel with this weeks announcement, and I wish them the best.

Once your application is processed with USCIS and you receive a NOA that your application is pending you enter what is called a "period of authorized stay by the attorney general or homeland security " which is not a lawful status (neither is DACA) but it will enable you to stay in the country until a decision is made without being in any fear.

Well it is very hard to understand and yes most americans don't know the differences and how hard it is to immigrate but all I was saying is I agree with the overall premise that legal immigration should be encouraged and not illegal after all thats why the US is such an amazing place to live thats why everyone wants to move here, because it is a nation of laws.
Germany is nice to visit especially the south , the architecture and culture is really nice.

Of course they are not , where did I say DACA recipients should be deported or anything, which is what you sort of implied I said.If you grew up here and went to school have no record and are a model citizen yes then of course there should be something made available for you to stay here, really everyone agrees on that . What I said is that the majority of americans including me want and are sympethatic for a resolution for DACA recipients. BUT you need to make sure that the border is secure that there is no incentive for new Moms and Dads to just bring there young kids across because they know eventually they will get legal status which you know ultimately will give the parents legal status too. You and a lot of people like you always make it so black and white but its really not. I have not heard anyone republicans or democrats that say we need to get rid of the DACA recipients but there is a talk going on, on what kind of measures should be taken in terms of what kind of legal status should be give so that no new illegal immigration is encouraged. Which is a fair discussion to have I think. That discussion is supposed to be held in Congress where laws are made and where it is at right now so I don't really understand the anxiety in that regard. This is not a country where you have a dictator that decides everything. Keep that in mind

Well I am not going to lie and say that it is not stressful but like with everything, there are two sides to the story and I do not want to create a rift. And I understand where mustang85635 is coming from. Thank you.

EAD/APs from AOS may be delayed by a month (beyond 90 days that is), but I haven't heard of cases where they have been delayed for longer than that.So considering PD of 6/5 and current EAD expiry of January 2018, you probably are in safe zone.
Again whether you can paralelly apply for another EAD based on DACA is something only an attorney can advise.

You should ask an attorney if DACA EAD will screw up your AOS EAD. If the answer is no, then I would suggest you to renew your DACA. You can't guarantee that your AOS will get approved, but at this point, you only have one month's window to renew your DACA EAD. Don't waste the opportunity before you lose it.

I think you should renew your DACA EAD just incase something happened to you AOS, you have a fall back. You only have until october 5th and that opportunity is pro **** ly gone for ever.
