  • Adjustment of Status Check list and questions!!! help..

    ok.. so i'm trying to fill the forms, i've been reading a lot about this whole process but still confused. in general i would say my case is not complicated but i'm not sure. so far i have this forms.

    I-485
    I-130
    I-130A
    I-131
    I-765
    G-1145
    I-864
    I-864A

    1. Can i fill the forms myself? i've seen theres nothing wrong with it but can i use 2 different handwritings??
    2. Do I need all those forms or am I missing any?
    3. i talked to a lawyer and she told me that after i mail this papers i don't have to leave the united states, according to my visa expiraton day it'd be Nov. 10, that i wouldn't get in any trouble because i am already married. is this true?
    4. this is our only marriage, when I-130 asks "information about your spouses" are we included in that or is that talking about past marriages only?
    5. is it true that is no longer necessary the G-325A??
    6. how much is the entire fee cost??
    7. 2 of the froms say "expires 07/31/2017" i downloaded them from the USCIS website and they don't have any other forms.

    1. Yes, you can fill out the forms yourself. If you don't want to handwrite them, if you have Adobe PDF capabilities on your computer, you can fill out the form on your computer and not worry about handwriting. I'm sure the USCIS officer reviewing your case will appreciate having a legible application. If you don't have Adobe PDF capabilities, I'm sure your local library does.

    2. It depends on your case, you would have to tell us more about your case for us to be able to answer that question. It seems as if you are applying to adjust status based on marriage to a US citizen, if so, yes, all the forms you listed are the correct forms.

    3. Not only do you not have to leave the United States, you MUST NOT leave the United States! If you leave the United States, USCIS will consider your application "abandoned." You can only leave the US if you have Advance Parole, which is what you are applying for with the I-131. Please note, however, CBP has complete discretion over who gets to enter the United States. The Advance Parole (Travel Document) does NOT guarantee you will be allowed back into the US!

    4. Your current spouse should be the first person you list. The "other spouses" are for previous marriages. If you don't have any previous marriages, leave those fields blank.

    5. Not sure, I did not file a G-325A (I am a US Citizen currently petitioning for my immigrant spouse). USCIS accepted my application without the G-325A

    6. The total for everything should be $1,760. This covers filing fees for I-485 ($1,140) I-130 ($535) and the $85 biometrics fees. The I-765 and I-131 don't have filing fees if they are being submitted concurrently with a I-485. The rest of the forms you stated do not have filing fees.

    7. Which forms were they? I wouldn't worry about it, but you can always call USCIS and ask. 1-800-375-5283. If you don't want to jump through hoops to speak to an agent, once you call, press 1 for English, then press 2, then press 2, then press 2...you will then be directed to a customer service representative.

      2. You need the medical, which is filled out by the civil surgeon on I-693 and put in a sealed envelope, for the I-485. You have I-864A which is for a household member's income to be included in the sponsor's household income, but who is the household member here? The spouse who is being petitioned doesn't need to fill out an I-864A to have their income counted because they are the intending immigrant. What other household member could there be? Is it a dependent?
      3. The that that you're "already married" is irrelevant. You can stay in the US for as long as you have a pending Adjustment of Status (I-485) application.

      7. The "expiration date" is for internal government use only and is meaningless for you, the user. What matters for you is the edition date of the form (on the lower left of every page), and the editions that are currently being accepted (which is on the form's USCIS page). The latest edition is always accepted, and sometimes old editions are also accepted. Sometimes editions can be accepted for many years past the "expiration date", and some other times an edition whose "expiration date" is still several years away is no longer accepted. Don't look at the "expiration date".
