I-485 family based application - after 2 years and 3 months no decision yet

  • I-485 family based application - after 2 years and 3 months no decision yet

    I applied to I-485 family based (spouse) in Sep 1 2015, I had my interview in May 2016 and I am still waiting for the decision. As I applied by my own, I consulted a lawyer to see if there was something wrong in the application - they informed all is right. When I call the immigration to learn about the status, their answer is always "it is still pending, nothing is missing". I wonder if there is something that I should do to move this process because it is SO disappointing to have the case pending after 2 years and 3 months. Any suggestion?

    Have you contacted your congressman? That sometimes helps.

      Call your congressmen, put in an online service request, request an infopass appointment.

        Wow! I have never heard anyone wait so long.. I have been waiting for a decision since Sept 2016 when I had my interview and I thought my case is taking forever. Mandamus is the last resort in cases like these...

          I am almost in a similar situation but not quite. I filed June 2016 and i never got my interview. Someone that I know filed around the same time as me already got theirs March of this year. I dont know what the hold up is with mine but every time i call or make an info pass to immigration they always say they are still reviewing my case. I even involved a congressman. And i received a letter that they were working on people that filed in May 2016 and they will schedule me for an interview shortly. Well that was like 5 months ago and I havent heard anything again from them. So I contacted a lawyer since like you i didnt use a lawyer initially and the lawyer told me to be a little patient. And if i still dont hear anything around beginning of next year i should file a writ of mandamus. Look into congressmen, if not ask lawyer what other steps you should take.

            I'm in the exact same position as you. We applied for my wife's 485 in Chicago on August 2015, interviewed January 7th 2016 and have not received a decision on her change of status yet. The interview went very well and ended with the officer saying she would recommend our approval and we should receive the information in a few weeks. 2 years later, nothing. We are frustrated to say the least. We've sent numerous inquiries, only to be told they are still working on our case and that they will inform us when it has been made! However, 2 years is just a ridiculous amount of time to wait on a "decision". We've never received any RFEs, our paperwork provided plenty of legitimate proof of a bonafide marriage. We've gone to infopass appointments, sent online/phone inquiries, involved our congressman, consulted with an immigration attorney who also sent inquiries on our behalf, only to get the same reply each time. "Were sorry it is taking an extended amount of time, we are still currently reviewing your case." At this point my wife feels hopeless. She is afraid to go anywhere on her AP, so she hasn't been able to see her family for 2 years. Her mom is getting old and is alone and her health is deteriorating.

            I've asked if there was anything we could provide additionally that would help them make there decision, but they say they don't need anything else.

            My wife has friends from her country who have moved here and have applied this year and have received there green cards already. Our case is somewhere collecting dust and no one is willing to make a move on it. We are at a loss. I hope that you find light at the end of the tunnel. This process is not supposed to be so defective, but it is. Good luck.

                I am sorry you are going through this. Two years is definitely way too long. On the upside though, you should be looking at 10 year Green Card when they make the decision. As soon as you get it, you should be able to apply for citizenship, as well.

                I would definitely have an attorney call a high tier officer and see what information they can get. Try a different congressperson.
