  • Danger Requesting I-94 replacement !

I'm about to file for Adjustment of status thru Marriage, lost my I-94 (entered the country on a tourist visa 1994 ) only proof i have is passport with faded stamp (Miami fla airport). Now my question is : Should i file for I- 102 NOW that i am out of status before i start my paperwork , or should i file for I-485 and I-102 Together . Being illegally now and filing for I-102 scares me because it will be putting me in the eyes of immigration OR it's normal to request that document before i start my adjustment , thanks for any answer in advance .

Unless you are a criminal you are very low on the ICE totem pole. It is very unlikely that when you request a replacement i-94 they will look you up and refer you to ICE for removal. I would file my both separately and use a photocopy of the faded stamp in lieu of i-94.

      Foia

I was in the same situation as you and requested mine through FOIA. It took about six months to get, but at least I had peace of mind.

        What's I-94?

Been to the US three times and I have no idea what I-94 is... I have been told to keep copies of it but I don't even know what it is.

I 94 is simply your travel history, google it and enter your passport info and other detail to print it for free. Cheers
