  • AoS on ESTA

    Hey all,

My fiance (US) and I (UK) are looking at the K1 process and it seems to take SO long, what would be the risks of getting married and applying for AoS while I'm there on a visit? I'm taking my daughter over in May and we're staying for 3 weeks. Assuming that we get through passport control (which won't be an issue as we've been a few times in the last year) is there any harm or risk of being denied if we claim that we just "decided" to get married and adjust status?

I'm having issues tracking down a change of name that my mother had done when I was a child and if this is a viable option for us then I see no harm in doing so, as long as we make it non-intentional?

We're so fed up of being away from one another. Is there a risk of them kicking us back out and refusing re-entry on a spousal visa, or would they be likely to just let us stay?

Yes, I know it's not the "right" thing to do, but I *really* don't want to keep coming back here and separating our family time and time again.

How can it be non intentional if you are already thinking it and asking for advice? Anyway if the CBP thinks you intend to get married and AOS they will allow to enter even with ESTA. However if you make it into the the US then you can do as you please. it wont be an issue.
