  • AOS - Marriage - J1 Visa

    Hey guys

    Just a back story. English Male. Me and my girlfriend met in Hawaii 2 years ago when i was in the US as a soccer for 9 months on a H2B Visa. As i knew i couldn't get placed there again the following year, we both managed to find work in Washington State and both made the move. I am currently here on a J1 Visa through a University exchange student programme and work for the same company as before, in programmes in Washington and Oregon. Because of this me and my girlfriend still don't officially live together, as i stay with host families during the season. On average i see her a couple of times a week, but in the off season i have stayed with her for months at a time and we have spent Christmas together too. We plan to get married next month, and following on from that complete the AOS.

    So my main question is regarding the proof of a bonafide marriage, by living together. Will this prove to be a problem in the interview, as i have never had a name on the lease when staying there? We looked to get a place a couple of months ago in Washington between our two prime locations of work, but it just wasn't realistic, as she works 12 hour nights shifts, and i may be in Portland for 2 months in the summer.

    All my documents iv received this year have all been sent to her address, including my new Social Security Card i had to get.

    Will the fact that we moved states together to be closer to each other, work in our favour through the interview process? She has also visited my family in England, and we have returned to Hawaii twice. We have plenty of photos of our travels in the last 2 years.

    Any documents you could recommend in the proof would be brilliant.

    J1 visa has condition to go back to your country for 2 years. You may apply for waiver and if you have plan to do so, do it as soon as possible as it may take sometime until USCIS approve your case.

      Does your J1 have a 2-year home residency requirement?

        No guys not all J1 Visa's have the 2 year rule. On my passport it states:

        Two year rule does not apply.
        Bearer is not subject to section 212(E)

          You can check online and also get an opinion from DOS that you are or not subject. This will be requested during your application.

            I think theres been some confusion there mate. I know i am not subject to the rule, it says it both on my passport and my ds - 2019 form.

            This is not the issue i am concerned about, my question is regarding the proof of marriage, and the living arrangements i have.

              I was a J1 participant way back Feb 2015. (no 2yr home residency req)
              Met my hubby (husband now) in August 2015, and started living with him in October 2015.
              J1 expired Feb 2016.
              Got married on July 2016
              Filed AOS December 2016
              Green Card Approved December 2017
