    hey guys, i know this may be a silly question. I just want to make sure i'm understanding the posted processing times correctly.


    So for Orlando office, it says the estimated time range is between 7.5 months to 16.5 months

    BUT there is a time range posted below (tabular information categorizing employment vs family based)

    The time range to process Family based applications will be between 12.5 months to 22months?


    Questions:

    1. So I'm assuming since i'm family based application being married to USC spouse, i won't hear anything until 1 year from my PD correct?
    2. When can I renew my EAD if it expires around December?

    For the Orlando field Office, I see 10 to 18 months for both family- and employment based applications.
    Then,
    11.5 Months to 23 Months Employment-based adjustment applications
    13 Months to 19.5 Months Family-based adjustment applications

    13 months is the time it takes to process 50% of cases
    19.5 months how long it takes to process 93% of cases (RFEs, incomplete, etc)

    You can think of that 50% as your median = mode = mean in a normal distribution, if you're familiar with that OR your typical case without complications. Remember that family based includes ALL categories; not just AOS based on marriage to US citizens. So you can expect it to be less than 13 months if your case has no issues because other family preferences have lesser priority but are included there. Therefore, those are skewing the number for a typical case.

      omg that's odd. like 5 hours ago, it showed 7.5 months hahaha!

      So basically in summary, it will be at least 10 months hey?

        LOL, the numbers were just updated. Apparently, it will happen every 2 weeks. The case inquiry date is updated every day.
        Yes, at least 10 months and of course, there are things that happen that no one can predict or account for. For example; a lot of people reported having their interviews scheduled right away and as employment based interviews and not as marriage based AOS. USCIS claims it was a system glitch. This happened in places like Chicago, IL where current processing time is 11.5 months to 32 months. So this glitch - probably some clueless new person in the mail room-cut the wait for a bunch of people by 1/2 or 2/3 of the time. But in the mean time, there are others in those cities who have been waiting a LONG time. We just filed 3/16/18 so I'm fine either way.

        The best you can do is keep USCIS informed of any permanent address changes, address any RFEs right away -hopefully you don't get any-, and keep collecting evidence. Truth is you don't have anything to worry about. You've been married for 2 years already. So you're going for the 10 year green card. However, make it easy for them to approve you and keep collecting evidence.

        I do think that straightfoward cases - first marriage for both/ no criminal record- move faster. Your case may just move faster once someone opens it because you've been married for two years already. So it's an easy adjudication. That's just my non-legal humble speculation here.

          Yes, first marriage and married more than 2 years. hopefully its as straightforward as it is.

          my EAD was approved in 56 days! I was surprised it got approved like 3 weeks after my biometrics

          Only reason I'm asking really is I have a trip coming up in 4 weeks for our honeymoon which was booked even before we decided to do AOS and i was still in Canada.

          It stressing me out because if we get scheduled during our trip, we lose a lot of non refundable arrangements we booked

          Regarding green card, really they can take however long they want, as long as I have EAD i'm good

            You're welcome! Glad to be of assistance. EAD in 56 days... that's fast. My spouse's biometrics were taken on the 12th and completed the same day. So hopefully, that puts us on a fast track. By the way, USCIS is sending interview notices 4 to 6 weeks ahead of the interview date. Unless your trip is longer than 4 weeks, you should be fine. To be safe, you can always get USPS informed delivery. USPS scans all your letter-sized mail, and sends you an image preview via email. It's pretty handy. You can even report missing mail right from your online account.

              its an 18 day trip! haha. i'm just really hoping i dont get any letter anytime soon lol
