  • Voluntarily submitting more evidence while waiting - anyone done it?

    Hi all

    I wish I'd found this forum before filing. I filed at National Benefits Centre in September 17, had one RFE returned in November. So I am about 5 months in. I have a new request for evidence in the mail, not read it yet.

    I have read a lot here about front loading with lots of evidence, photos etc, and I thought that was interview stuff.

    Has anyone submitted further evidence during the ongoing process. Is this a good idea, would it be accepted or cause complication.

    If the RFE is specific, and I respond to that, should I include additional standard evidence at this time. For example, getting on my wifes health insurance, couldnt do it at the time, as I had no Social Security number, I now have that additional evidence.

    PLease any advice would be great

    dont bother, if you get rfe reply with only that evidence. all others stuff they will ask at interview to show anyway.

      Don't worry. It's a widespread misconception. Apparently, not one single attorney has read page 3/12. I will leave that at that.

      I would only attempt to send evidence you were required to send but couldn't or thought you could bring to the interview IF you have a RFE for ANYTHING - a staple. You respond to the RFE and with it, include your evidence of bona fide marriage. Along with that, a brief cover letter that says something "please kindly accept this evidence of bona fide marriage and include it with my form I-130 -receipt MSC123456789- as part of my initial submission of evidence". You get the idea. Find your own tune.

      It may or may not be accepted. More likely than not, it will be accepted, because you are sending it with an RFE issued for another reason. Then, whoever gets it should be able to add it to your file. I've read that people have fixed errors WITHOUT a RFE by calling and getting a ticket #/confirmation number for your call/request, and keep following up without pestering until they are told the evidence did reach their file. You should call, as well. Do not be surprised if after all that, it does not. Therefore, you must keep an exact copy of everything you send them with this RFE.

        Some people front load their packages thinking they have a higher chance of getting a green card or speedy process. Truth is, some do while others don't. I think it's best to just give them what they need during this time, you can take more evidence at the interview. I have two relatives that just followed simple protocol by sending what they needed and they were successful at their interviews and now are citizens. Also, I received a Courtesy letter informing me that I would need to take my I693 with me at my interview and it said NOT to send any evidence they did not request because it will lead to my case being delayed. I don't think you would want to risk that. Just be patient.

          Front-loading is just following directions on Page 3/12 & 7/12. People choose to ignore them and do otherwise. Many come out unscathed. Many do not. I've been there. Just because many get by not following the directions, that does not override the directions. It's all there. So when a Notice of Intent to Deny arrives in the mail, like it happened to the gentleman on that thread that generated all this talk, it should be no surprise.

            Whether you ultimately decide to use that RFE and piggy-back evidence on it OR not, the important thing is that you are now aware of what the directions state. Furthermore, you are also aware of the mess that ignoring them can cause. And hopefully, others will be able to prepare if all they sent was evidence that the marriage occurred and was registered. The fact that we are discussing it, is what's important.

              Front loading evidence can not hurt you but can be very helpful as the IO will have already read your file and has an idea of whats in front of him. When I did my first AOS we front loaded a lot and the interview was very brief and approved right away. We front loaded again this time and i-130 was approved without an interview [ day before interview]. At the interview was only asked about previous green card, abandonment and the YES/NO questions in i-485. Based on my personal experience, I will advise everyone to front load their applications.

                Thanks to everyone for the advice

                I'll be honest, I did not think the instructions were referring to loads of additional evidence, pictures, letters etc. I only included official things, marriage cert, signed statements from people at the wedding etc. I honestly thought that part was for the interview.

                This forum is great, I really wish I'd found it before filing.

                  It's nice you were able to see the I-130 was approved 1 day before the interview. Saw no issues with the bona fides of your marriage and approved it. I would be relieved knowing all that's left to deal with is that adjustment/admissibility part. If the I-485 is not approved, well... consular processing it is, because you have that I-130 in hand. -That's not your case. You've got that 10 year green card in your back pocket already-

                  I think they're going to turn around and say something dumb like - well, we can either send you a new green card or you can just file for a replacement card" Take the new one. Replacements take TOO LONG.
