Proof of income for Green Card Interview- Tricky Situation

  • Proof of income for Green Card Interview- Tricky Situation

    I am sponsoring my immigrant husband for his green card. Under 1-864 Affidavit of support I mailed proof of my income (paychecks and previous tax returns) proving that I am earning enough to support both of 125% above poverty level ($20,575 a year). Yesterday I was unexpectedly fired from my job- and that same day I received an update saying that our Green Card interview is ready to be scheduled (worst timing ever!) At the interview I will need to bring in my most recent pay stubs again- but since I am now unemployed- I have no income to support my husband.

    Also my husband has been working full time for a year. His pay meets the income requirements to support both of us. But he is undocumented and he is paid off the books. He has his pay stubs, proof of employment, but he hasn't filed a tax return. And the USCIS website says that the most recent IRS tax return must be provided. So I don't think the interview officer will accept his income to meet this requirement. Maybe I'm wrong?

    Also, the value of any assets you own can be used to supplement your household income requirement if it doesn't reach the required amount. According to USCIS: In order to qualify based on the value of your assets, the total value of your assets must equal at least five times the difference between your total household income and the current Federal Poverty Guidelines for your household size. (In my situation- this would be $102,875 since I have no income). I own a home which is paid off and worth $280,000 which I will use to try to meet the requirement. But what is unclear is if I am still required to show current employment/ household income- or if I can use the value of my house alone, in the absence of a job. I read conflicting information on this- another section saying that you need to show current employment, and suggesting that the value of your assets is only meant to be used as a supplement. Any advice on this?

    I am also willing to take any quick job I can get, just to show that I have income (my assets would take care of the rest). However I don't know yet when our interview will be, and I will be taking 2 trips overseas beforehand, so the timing will be difficult for this. I'd appreciate any advice!

    Get a joint sponsor as soon as you can just incase you don?t get a job by the time the interview is up. Your husband income won?t count because he is undocumented. They might not approve your application so work on getting another job or get a joint sponsor ASAP. Praying that everything goes well with you.

        Thank you for your reply. The only people that would be willing to be joint sponsors would be my parents. They are retired, have no income but own plenty of assets. According to USCIS, the income requirement can be met with: "A joint sponsor whose income and/or assets equal at least 125 percent of the Federal Poverty Guidelines". However, the value of my house alone more than meets this requirement. But it is still unclear to me whether or not if I am still required to have a job in addition to these assets. If I can quality with just my assets, in lieu of having a job, then getting my parents as joint sponsors would be redundant I think. I'm really not sure about this. I appreciate your advice and well wishes!

              You can only use one or the other. If you choose to use your house it should be plenty and you wont need to show any income. Also as the spouse of a US citizen you only have to show assets worth 3 times and not 5 times.

                Ok- thanks for this advice. I hope this is true in my situation, and that the immigration office will not deny the green card for not having a job. It's very crucial that we get this right. A denial would be devastating for our future.
